I inherited a condo in 2001, my father built a freestanding BBQ 15 yrs
ago (approx 1990). This BBQ was there when the patio cover was
inspected and the AC condensor was relocated and when the BOD had the
wood fence replaced with a split face block wall in 2001 (after my
father's death but before I was deeded the property). The BOD wanted
the BBQ removed, sented "notices" to the wrong address (which I can
prove/document), refused my inquiry to the meeting local where this
specifc chain of events was to be discussed; refused to hear that the
BBQ was there passed the Statue of Limitations (5 yrs); never sued me
stepped into a court of law and 5 days later proceeded to take a
sledgehammer to the BBQ. Then sent me a letter (after the fact)
stating that I was not an owner & had no interest (however I do have
the fax transmission report, cover letter referencing the deed
changing ownership in 2002) copied my tenant on the letter and my
tenant questioned who he was paying his rent to. I have down research
into the Davis Stirling act, I was offered no Alternative Dispute
Resolution no Court Order was obtained and the service of any
"notices" is bad. HELP!!!
