This kind of legal research can be quite time-consuming, and the Researcher who answers your question will earn only $7.50 for his or her labors. You may be more likely to get an answer if you increase the price. |

I'm no lawyer or construction expert, but maybe these sites can help: http://www.nixonpeabody.com/linked_media/publications/ILA_10212004.pdf Scroll down to Georgia. (I don't know if this is at all applicable.) http://www.legis.state.ga.us/cgi-bin/gl_codes_detail.pl?code=8-2-36 http://www.constructatlanta.com/legal/liability.html http://72.14.221.104/search?q=cache:B5cXB8eDbnEJ:gsfic.georgia.gov/vgn/images/portal/cit_1210/27/54/41665233DESIGN-BID-BUILD%2520Construction%2520Contract%2520Training.ppt+georgia+construction+warranty+period&hl=en&ct=clnk&cd=9 Sorry about the cache string. The title of the site is "DESIGN-BID-BUILD Construction Contract" Warranty period is mentioned near the end of it: 12 months. These two sites also refer to 12 month warranty periods: http://www.deangelisdiamond.com/warranty.php http://www.nasadigitaltv.com/pdfs/Wegener_Terms_and_Condition_of_Sale.pdf I am afraid that doesn't look very positive for your case, but as one site mentioned, it could be possible that a longer warranty period has been specified, but you would have to see the documents for the construction to know. It would be a whole different can of worms to argue that the erosion control system installed was not that in the plans you have seen. Possibly there was an agreement to accept this, thus maybe shifting the responsibility to party that agreed. This is not much help, I am afraid. |

I was surprised at only a 12 month warranty on new construction. In California it is 5 years for not-obvious defects, and 10 years for hidden defects. |

Thanks myoarin, that 3rd URL indicated construction liability exists for 6-8 years in Georgia. |

I certainly hope so. I oversaw that. Good luck! |
