Can you send me an article or publication regarding the legality of
using an online signature for a waiver, for example, by posting the
waiver and asking the person to hit "Accept"? I know a lot of people
use this, but I cannot find any information on the legality of it. I
help run a rowing team and would like to convert our registration
process to the online option instead of handling all the paperwork. I
would like to present this to the
board, but will need to convince everyone that we will be covered
legally.

Hi abbycookie,

I have another idea... I think you may be considering something similiar to this:

USRowing Membership Application
https://stanweb.onet.net/usr/ssl/application_new_agreement.asp

What I would do is talk to these folks... I selected a Rowing web site
so you have a basis on which to talk.

US Rowing
https://stanweb.onet.net/usr/

CONTACT PAGE:
https://stanweb.onet.net/usr/itemdisplay.asp?id=122
Ask to speak to their legal department.. Let me know if this is helpful.

~~Cynthia

I just called them trying to get the number to their legal department:

1-(800)-314-4ROW

They are closed now, close at 4:30pm east coast, but they mention "you
may now become a member and sign the waiver online at their web site
--on their outgoing phone message!

Sounds to me like you need an electronic signature. I think even the
US government accepts/requires them on certain documents. If there
are definite legal implications of ACCEPT, then you need more than a
click by a non-verified person on a URL button.

One must obtain that legal signature from some signature supplier to make it valid.

Sorry I can't tell you more, that's all I know.
