I'd like to create and sell products (t-shirts, bumperstickers, etc.) featuring a phrase I coined that includes the name of a fictional character from a popular book. The USPTO site shows that there are trademarks on this character's name (a similar trademark, as an example: http://tess2.uspto.gov/bin/showfield?f=doc&state=mpbfhu.4.4). So my 2 questions: 1) Are these trademarks for particular designs featuring the character's name, or for ANY design featuring this name? 2) Can I legally make and sell products using my phrase that includes this character's name? |

Hello dinkinflicka, 1) The trademarks are generally for all uses of the trademarked term. 2) Generally, you cannot legally make and sell products using a trademarked term. It has to be licensed from the owner of the trademark. tisme-ga |
