On the morning of 4th of July 2006, I was walking alongside a drunk guy I met
at a bar. We were wandering around to figure out which bar to hit next. Anyway,
this guy, let's call him Daniel, had a malfunctioning cell phone (amongst many
other dysfunctional baggage). He handed me the open alcohol container
(that he was drinking from) so that he could play around with the cell
phone with both hands. Next thing you know a cop pulls next to me and
requests me for ID. Daniel immediately grabs the
bottle and tosses it into a trash can. The cop is in the car now writing a
citation. Daniel assures me that it is *all cool* - you are not from
this country etc. etc., so you won't have to pay. Even if you have to,
it is just $35.
Anyway, I get a summons and Daniel starts talking about *critical mass* and
cops running over pedestrians and the cop possibly forgets to get my signature
in the summons. Now, I am researching on the web, how do I fight it? Well, I
do live in USA and want to fight it to my best, without hiring a lawyer(big $$)
Do I have a chance of winning this?
What documents will I need to produce?
Will I need to round up this guy Daniel, to take the confessional? If so, is he
going to get penalized/charged?
(The cop did not note down the alcohol type/brand in the summons)

How much is the citation for?

If it's $35 as mentioned, just pay it. You're offering $20 here to
find out how to fight it and a lawyer will cost far more. This isn't
a major offense, it's not going to follow you for life, it's about as
big a deal as a speeding ticket.
