My wife and i have been together for 13 1/2 years but we have been married only
6 1/2 of those years i owed a property before we married and and sold
it. i didnt divide the funds with her but we both used the funds in
our daily living.
later i inhearited another peice of property from my mom after we had
been married. she deeded of because there were siblings involved. I
went in and repaired the hope with with funds from my job and refinace
and paid off my siblings we always keeped seperate savings and
checking but she was a lot better at paying bills than me so she wrote
the checks out of my account and saved her income.We found a nice
three unit property that we both really liked.
so we decided to buy it. i had a few lates on the mortgage so our rate
was really high. so we agreed that she buy it as her seperate property
and get the rate lower, All went well we rented out both properties
and lived in a house that a friend owned that lived out of state .we
both have real estate license . I have a 9-5 because (it keeps us
going in a slow market and takes care of our medical and dental) We
have 2 foster kids and the old house is getting kind of tight oh yeah
i was the agent on the unit deal and gave my whole commission toward
the purchase. plus maintained both properties after work. We tried to
find a new house for this growing family but with run away cost in
calfornia good luck. we decided to take the rear unit tear it down and
buid a large beutiful 3000 sq ft 4 bedroom house we started to runout
of funds we were using a lot of what she saved and lived for over a
year on only what i eared we still ran out of money so i didnt want to
get rid of the old house so i sold it to my wife in her maiden nane
she deeded it back we took the money and finished the house by then we
were frustrated and tired and fighting she moved into the new house i
stayed in the old house for three months we hated it
i moved into the new house with my family. and it was good for about 10 months
we still owed the contractor so he named us both in a law suit and
filed a mechanis lien for 20,000 dollars and we didnt have it so i
sold the old house
and paid the lien the end (not quite) every month we collect the rents
from the tennants and i give her a check for the balance of the
mortgage. We refienace and faid all the wholesalers off now three
years later she is so unhappy and wants a divorce and said this is my
sole and seperate property
so you should move great story but THE QUESTION IS HAVE WE COMMIGLED
ENOUGH FOR THIS TO BE COMMUNITY PROPERTY- I WANT TO BE FAIR BUT I PAID
THE MORTGAGE
ON THE OLD AND NEW HOUSE ME AND THE TENATS PAY IT ALL PLUS ALL THE UTILITIES
FOR US AND WATER FOR THE TENNANTS SHE WAS SOPPOSED TO BE SAVING FOR
THE NEXT AQUISITION. WE PAID 236,000 FOR THIS PROPERTY. I PAID FROM
RENTS,EMPLOYMENT
AND SELLING THE OLD PROPERTY 50-TO-60,000. IN BUILDING COST 3000.A YEAR OR MORE
IN UTILITIES. ALMOST ALL THE BUILDING UPKEEP UNLESS IT'S OVER MY HEAD
ANOTHER 20,000 IN LAW SUIT FEES SHE REFINACED AND GOT 70,000 THE FIRST
TIME TO PAY THE CONTRACTORS AND FELL SHORT THEN PULLED ANOTHER 126,000
TO PAY HE MATERIALS
THERES A 390,000 BALANCE ON THE MORTGAGE THE BUILDING IS VALUED ABOUT 1,050,000
AND THHE ONLY PEOPLE PAYING FOR THE LOAN PLUS STANDAR COST
UTLITIES,ECT IS ME AND THE TENANTS SHE WAS SOPPOSED TO BE SAVING. SO
AGAIN IS THIS STILL HER SOLE AND SEPERATE PROPERTY |
