I own a rest. that seats 65 people, before this rest. I had a smaller rest. afrer 6 years I decided to move to a bigger place, with a partner. After not quit a year he decides Im stealing, he hasnt made a profit and wants out. He was 1/3 partner. My contention is its a rest. its not an over night success. He didnt stay in long enough to realize a profit. Id like stats that prove the rest. business has a high rate of failure and stats stating how long it takes to show a profit. He cant prove misapproation, but wants 100% of the rest. The rest. I started and owned for 6 years. He has never been in the rest.business before. And has not worked 1 day in our restaurant, I on the other hand work it 12 to 15 hrs a day. I see good potential. | |

It sounds as if you need to consult an attorney. |

You can find a study that will report that 90% of new restaurants fail in the first year, and you can find a study that says that is far from true. I would hire an attorney and let them do the heavy lifting. |
