My neighbor (husband) passed away a few months ago. Several weeks ago, his wife received a bill for $2200 from our Home Owners Association for repair work blamed on her late husband. This fee has been added to her account and since she did not pay it, her account has become delinquent and her parking privileges revoked. I believe that late fees are also being added to their account. Can the association perform repairs without notifying the wife? Their claim is that the husband was notified before his death but no evidence has been presented to support that claim. Is it better if she pay the bill and continue to question the charge or refuse to pay until the matter is settled. We are living in Virginia and several residents in ur community are outraged at the association punishing a widow for something her husband may have done without her knowledge. |

Without evidence that the couple was duly informed, the association has no leg to stand on. |

If the Home Owners Association did the work after her husband's demise, then they've no excuse for not having informed her of their intent to do so. Especially since the gentleman had died, one would think that they'd have the good sense to make sure that his widow was aware of any prior arranged agreement. If they have no legally signed documents, then they are (as far as I'm concerned) at fault. You & your fellows ought to hire an attorney. |
