Question ID: 759880
Are decisions made by Australian universities directly affecting
students justiciable? Should they be?
Consider the position of universities established under Commonwealth
and under NSW legislation.

Note: particularly intersted in the regime applying in New South Wales (NSW).

The answer to your first question, at least, is cleary YES...there are
many examples of cases brought by students against their universities,
and the courts have agreed to hear the cases.

This doesn't mean that all decisions affecting students are
justiciable, but clearly, many are.

Would links to appropriate cases on this topic serve as a suitable
answer to your question?

If not, what sort of information/answer were you hoping to receive?
The better you can describe your expectations, the better we can
assist you.

Thanks,

A short summary of say 1500 words covering the following would be good:
-Explanation of justiciability under Commonwealth regime
-Evaluation of Commonwealth regime
-Explaination of justiciability under NSW regime
-Evaluation of NSW regime

Summaries of and links to relevant cases would also be good.

Thanks for clarifying what you need. I won't be undertaking this task
myself, but perhaps another researcher here will be able to assist
you.

All the best,
