Everytime I see the word Crystalinks I get angry. Although it is a
great compilation of information, she (Ellie Crystal) does not
acknowledge her sources, and what she does is basically theft.

For example:
http://www.crystalinks.com/pyramidsamoa.html
http://www.survive2012.com/asia_pyramids.php

I took that photo, stood on that pyramid, wrote some of those words.
Zero acknowledgement.

Her site's home page boasts of:
Successful Hits For Thursday August 31, 2006 1,119,641

a) I think she is stupid/obsessed/too-nice-for-her-own-good not to be
running ads on her site. She could probably make $500-$10,000 a day
from AdSense ads

b) She's lucky she's not profiting from her plagiarism, otherwise
she'd be sued by now

c) Her wonderful site, Google PageRank of PR8, just by linking to her
sources could help all of them immensely in search rankings.

MY QUESTION
------------

What can I do? I have already emailed her and my email was not replied
to. She's not profiting from my writing/photo, so suing her would be
expensive for me, without any hope of financial recompense.

How can I stop her reproducing my work without acknowledgement, or at
least get a link to my source material?

Thanks,
Rob

Howdy Rob,

There is a great "tool" out there called the Digital Millennium Copyright Act
(DMCA) that will allow you to not get angry, but get even.

The SEO Logic website has a great introduction on the proper way to approach
using the DMCA. You should read the entire article for the details on all
that you can do under the DMCA, depending on how "even" you want to get.

Here is the main thing that you want to do.
http://www.seologic.com/faq/copyright.php

"File notices of alleged infringement (DMCA) with the Webmaster's hosting
company or ISP. You can have the site removed from the server where it is
hosted. But first, you have to find out where the site is hosted."

We can use the Domain Tools website to do a "whois" to see if we can locate
the ISP for the Crystalinks website.
http://whois.domaintools.com/crystalinks.com

The "whois" information we want is:

IP Address: 82.165.148.74
IP Location: - Schlund + Partner Ag

Another Domain Tools utility we can use is a DNS (Domain Name System) lookup
on the IP (Internet Protocol) number from above.
http://dns-tools.domaintools.com/?m=dns&q=82.165.148.74

From the above we get the hosting company domain name, Schlund.de. For more,
we do another "whois," this time on Schlund.de.
http://whois.domaintools.com/schlund.de

Name: Hostmaster SCHLUND
Address: Schlund + Partner AG
Address: Brauerstr. 48
Pcode: 76135
City: Karlsruhe
Country: DE
Phone: +49 721 91374 50
Fax: +49 721 91374 20
Email: hostmaster@schlund.de

Alternatively, or additionally, you could email: abuse@schlund.de

You should visit Elliot Back's website for a good sample letter to use.
http://elliottback.com/wp/archives/2005/10/page/2/

"... was totally ripping off my content, so I filed the following DMCA
notice with their hosting provider [Schlund]: ..."

The Wikipedia entry for the DMCA has a template for a DMCA request.
http://en.wikipedia.org/wiki/DMCA

"This text contains several items to respond to. It can be sent by fax,
ordinary postal mail or even put on a website at the disposal of the
provider."

Schlund + Partner has a contact page. Be aware that it is in German, but the
contact information is easy to discern.

Schlund + Partner AG
Brauerstraße 48
D-76135 Karlsruhe

Telephone: +49 721 913 74-0
Fax: +49 721 913 74-20

Email: kontakt@schlund.de

From the whois on Crystalinks.com we can also see that 1&1 is doing the name
serving for the website, so it probably wouldn't hurt to contact them as well.

Phone: 1-877-GO-1AND1
Fax: 610-560-1501

Email: abuse@1and1.com

If you need any clarification, please feel free to ask.
