Question ID: 763039
I noticed unauthorized charges on my card statement appearing as:
AP9*GALLERIA 888-522-9808 QC. I called that phone number twice, each
time talking to a different representative and manager. I researched
the AP9 scams, and found these links:

http://secondchancecritic.com/forum/viewtopic.php?t=52

The charges have been 17.95 CAD every month since January. When I
called the company, they offered to cancel my "membership" (which i
was getting nothing for) and refund the last month, but not all the
others. I insisted, they said no. Both times, I asked for them to
refer me to the webpage that they claim told me I would be paying this
amount every month, and they wouldn't. They said they can't do that,
they just said to go to the dealpass.com homepage, which was full of
BS. Many people have had this problem with AP9 affiliates, and I need
my money back as I am a student saving for college and can't afford to
be scammed. I spoke calmly the whole time with this company and kept
my cool, except I told the manager at the end of the call that the
next call would be from my lawyer - i was totally bluffing. I also
told the lady representative that she sounds like a nice person and Im
sorry that she has to work for this company. Said the similar to her
manager.

So then I called VISA, and they can only get me one additional month
refunded because it is passed 60 days or something. She said that even
for that refund, she has to research for a week to make sure that i
have indeed been scammed. She was very nice and concerned, but I
believe that VISA could have done more to help me. Isnt there some
official forms I can fill out? She also told me that if i wanted to
help, I should continue nagging the company.

Question: What should I do? Should I call the company 5 times daily
for a week and hope for the best? Or will that get me no where? Does
VISA actually have the ability to reverse all the charges from January
like i suspect? Help!! Thanks very much in advance for any comments or
answers anyone can give me. I would assume it is illegal to
impersonate a lawyer, right? :D I dont think i could pull it off
anyway.

Yeah looks like you are out of luck here, not much you can do to get
your money back. Because it is a small amount on a monthly basis most
law enforcement agencies wont do a thing. I had a similar issue some
time ago, but I was relentless not so much because of the 200 bucks
but because they really peeved me off. Eventually the bank decided to
credit my account from THEIR money so that the issue would go away, I
protested and told them I didn't want the banks money I wanted MY
money back from the scammer. But since the bank had refunded my money
for all intents and purposes I had no further claim. That peeved me
off even more lol

They decided to do this because in my case it was a United Statesian
company and I could do something about it, I was going to take them to
small claims. Of course I didn't expect them to show up for their
defense but the plan went like this. I take them to small claims win
by default (they would not travel from CA to VA to defend themselves,
and if they did I would win anyways) then sell my claim to a
collections agency I would also create for this purpose. The
collection agency would instantly start pestering them on a daily
basis via fax, e-mail, certified US mail and phone calls. It would
keep track of all these attempts at recuperating the money and with
each attempt it would also include a bill for the attempt itself, each
time the charge they would owe the collection agency would go up by $
50.00 by the time it reached the $ 10,000 level it would no longer be
'small claims' at that point I could either put a lien on the
properties of the companies or sell the claim to a real collections
agency for $ 500 or so.

My bank though thwarted my plans.... :-)

Thanks for the info, and your own experience. I would like to try
this, but it appears that the fees would be 220 bucks - probably more
than what i have been scammed. It would be nice to do it out of
principal, but i cant afford to. I dont want the bank to have to pay
it... but it would be better than nothing. So as i understand, there
IS actually more that the lady can do for me, right? Should i be a
jerk and keep persisting with this nice lady who is just trying to do
her job? I think i will keep trying to nag the company for a couple
weeks. Anyone want to help nag them? Call 888-522-9808, and just ask
for their manager. Any further help or advice would be great. THanks
again elids :D

I'm a tad confused...

You just found out that these charges were on your Visa statement???

If they had been processed every month since January, why have you not
noticed them before ???

When I get my monthly statement, I scrutinize it for each and every
charge, just to make sure I know where they are from.

Steph, that was probably the most unproductive comment I have read on
this site. OF COURSE i should have looked at my bill and noticed it
sooner. But it wasnt in my "fun things to do on a rainy day" list.

Ok, Joel....

Sorry, I didn't mean my previous comment as a personal attack...

I was just concerned.

Good luck!!!
