I am waiting the approval for H1-B (which already has been filed and expedited through premium processing) from my current non-profit employer (I have been working on OPT for almost a year now with this company). I have an offer from a profit company. As far as I understand the portability law allows me to transfer the H1-B to the new employer. Here is a question: WHAT ARE THE RULES FOR CHANGING COMPANIES (?A? to ?B?) UNDER H1B, WHEN COMPANY ?A? WAS QUOTA EXEMPT AND COMPANY ?B? IS PROFIT COMPANY. To clarify this further: 1. Am I eligible for transfer being that I am going from non-profit (exempt from the quota) to profit? 2. If yes, then will I be counted towards the quota? 3. Can I apply for transfer as soon as I receive the approval of H1B from my current employer, or do I have to wait few months and work under H1B (even though I worked for a year for this company under OPT) 4. What if the salary is higher on the profit company (say 30-60% more), but it is similar type of job? |
