My girlfrind and I are breaking up and selling the house we bought jointly. She wants all the equity in the home which is fine with me, I just want to start a new life and move on. My question is, if I sign the "Quit Claim Deed", will she be able to force me out of the house before it sells? | |

If she is agreeable, she could give you a lease that terminates upon the sale of the house. |

Almost certainly. Right now she cannot "evict" you as you are an owner (of some flavor.) After you sign away your ownership rights, you become a tenant who can almost certainly be evicted. She would have to use the courts do effect an eviction. The fact that you don't pay rent, etc. is no defense. Don't sign the deed until you're ready to go. weisstho-ga |
