I was hit by a mercury insurance customer who made a left turn into me
(explained in police report with statement), he recognized at the scene
he did not see me. I had dirven less that 400ft and was going less
than 25 mph. Mercury insurance alleges
I was speeding "based on the damages", I was not speeding and the
evidence supports me. Can I sue the driver for car damages and without
disabling me from filing the injury claim?

Why are you having to deal with their insurance company? Why isn't
your insurance company handling this for you?
