I GOT MARRIED SIX MONTHS AGO. MY SPOUSE AND I OBTAINED THE MARRIAGE LICENCE PRIOR TO THE CEREMONY BUT WE NEVE FILED IT WITH THE LOCAL COUNTY OFFICE (NEVER HAD WITNESSES OR THE PRIEST SIGN OFF ON IT). SEVERAL MONTHS AFTER THAT WE SPLIT...AM I STILL LEGALLY MARRIED TO HIM? | |

Marriage is a legal dependence. The oral vows are binding, and that's the purpose of the witnesses. You are legally married when the minister makes the pronouncement. Paper work problems among willing couples are simply worked out. If someone wanted out of a marriage which had paper work problems, the other party could sue for breach of contract and possibly require the other person to end the marriage through divorce. A serious misrepresentation of oneself could be grounds for the other party to seek an annulment. |

This is a legal question for an attorney in your state. However, since you never filed the papers with the government there is no record of the "marriage". To make things right with the church you should see what they require to disolve the marriage. |
