As a researcher on Google Answers, I cannot provide expert advice
about New York state law. Only a lawyer qualified to practice in New
York is competent to do that. In other words, as a researcher, I can
only provide the results of my research, and not with the
legally-sophisticated answer that a New York lawyer could give.

So the first part of my answer is that you should consult a lawyer in
New York State, and particularly in Suffolk County. Here are some
legal resources in Suffolk County:

"Public Resources: Suffolk County"
New York State Bar Association
http://www.nysba.org/Content/NavigationMenu/Public_Resources/Legal_Information_by_County/Suffolk.htm

As for the results of my research, it appears that Suffolk County does
not have a probate code. The Table of Contents for the Laws of
Suffolk County does not seem to contain a topic like probate, and
searches for the words "probate", "wills", "estates", or "trusts" fail
to find any Suffolk laws on this issue.

"PC/CodeBook - Laws of Suffolk County, NY"
http://gcp.esub.net/cgi-bin/om_isapi.dll?clientID=388910&infobase=suffolk.nfo&softpage=Browse_Frame_Pg42
[available by clicking "Online Documents" on
http://www.co.suffolk.ny.us/legis/ , and then clicking "Search The
Laws of Suffolk County"]

Instead it appears that probate is regulated on the State level:

"New York State Consolidated Laws : Estates, Powers & Trusts - Index"
FindLaw
http://caselaw.lp.findlaw.com/scripts/getcode.pl?code=NY&ls=claws&frame=right1&law=38
[available by clicking on "Alternate Site (search)" for "New York"
under "Probate" at
"Topical Index: State Statutes on the Internet (Part III)"
Legal Information Institute (at Cornell Law School)
http://www.law.cornell.edu/topics/state_statutes3.html#probate ]

Also, it seems that New York has not adopted the Uniform Probate Code,
at least in its entirety.

"Uniform Probate Code Locator"
Legal Information Institute (at Cornell Law School)
http://www.law.cornell.edu/uniform/probate.html

You can confirm whether this information is accurate and complete by
checking with a New York lawyer or legal service.
