My N-400 application for naturalization was administratively closed on June 30, 2000. I received a letter from the USCIS (Charlotte, NC) to that effect on March 9, 2006 (I was out of the US for about 5 years from Jan. '01 to Aug. '05, and did not follow up on my case until Feb. '06. I therefore received a letter of an administrative closure in Mar. '06). Now I want to re-open my N-400 case. I cannot file a new N-400 at this stage because I do not meet the physical presence test. My questions are: Can I file a motion-to-reopen my N-400 case? If I can, where do I file it? How long does it typically take to be adjudicated? Will the fact that it has been over 5 years since it has been administratively closed have some bearing on the motion-to-reopen? Thank you in advance for your time. |

The oath letter contains questions (I think about 10 of them) to which you must answer 'NO' to all prior to naturalizing. The questions pertain to events which may have happened in your life since your last interview. Example:- marriage, birth(s) in your family, arrests/warrants/indictments, traffic/parking tickets, international travels, polygamy, etc, etc.... Any 'YES' answer necessitates further interviewing with one of the supervisors before being allowed to naturalize. So depending on what "events" happened since your LAST INTERVIEW (not before), say, a paid parking ticket hopefully won't bar you from naturilizing but a DWI ticket will. Remember that not everyone who received oath letters and show up ultimately complete the ceremony. Sorry, if this isn't the information you were hoping to hear. Goodluck! |
