I recently change my name. Under my U.S. Citizenship is my old name. I change my last name because I just discovered that my real ancestral name. I change my name after a few months that I obtained my U.S. citizenship. I have been consistly using my new name for about 4 years. I recently apply for my U.S. passport under my new name and I was denied beacuse the name I put on the application is under my new name. The passport agency said that the name on citizenship does not match my new name. They gave me 90 days to re-submit myt application with proof of my name change, but the 90 days has passed already and I have not yet submit the papers because I was confused. I change my name by using the USAGE METHOD. For now, the passport agency is holding my U.S. citizenship. I sent in my U.S. citizenship through United States Postal Service when I apply for my U.S. Passport. Is it possible for me to get back my U.S. citizenship to reapply again? What are my options to get my new change recognized. Do I have to wait for 5 years? What is the fastest way to get new name recognized? Please advise.. |

< The way that you have changed your name is perfectly acceptable under U.S. law. However the procedure that you used to get a new passport was incorrect. As your name was changed by usage, the correct procedure is to apply in person for a new passport. The fact that you did not respond to the request of documents within 90 days makes it likely that your application has been considered abandoned. Your first course of action should be to contact the passport agency to try to get back your documents. If this fails then you will need to apply for a replacement of your certificate of citizenship. You can apply for a replacement by completing form N565. A link is given below where you can find instructions for getting a replacement certificate of citizenship. When you have your certificate of citizenship you will be able to apply for your passport. To get your passport in your new name, it is necessary to make an application in person by going to one of the passport agencies. A link is given below where you can find the location of the nearest passport office. Make sure you have the necessary forms of identity, passport photographs and the passport fee with you. The link to passport services and information details what forms of identity are acceptable. You will need to complete a passport application form which can be downloaded from the site shown below or alternatively one can be obtained from any passport agency.
