i just got a mortage on my home which was paid off.i got on a website
to check my home out and found out that since ny loan  of 1 week has
put my spouses name on the deed. this was mine and my boys house years
before i met him !  i already wrote out my will pputting  my assets
divided equally between all 3.im not in my right mind and my spouse
knows it because i have stage 3 to 4 liver disease.he pressured me
until i gave and couldnt take it anymore.the money is already gone for
home repairs.i am only 44 years old.because the loan was in both of
our names did the mortage company have the right to put his name on
the deed?  please help with answers.time is very crucial.  thank u.
and yes i do believe my husband knew they would do this.

If you're in the U.S., some states' laws in this regard are what's
called "Community Property". This means that your spouse owns 50% of
your your property's equity, and is liable for 50% of your debt.

To further what Qed100 says, lenders usually want recipients of a loan
to have an interest in the collateral. As there is a raft of papers
you sign for loans that nobody reads (except me-- I cannot count how
many times I've been told "you're the first person to read it"), you
may well have agreed to something unintended.

If you feel you cannot trust your spouse, see an attorney right away.
Indeed, you should have already consulted with one to get your affairs
in order.

i live in ohio 45044,  united states.  also i just cofronted the loan
company,  i was told that it doesnt say anything in the papers i read.
 i threw a crying fit and told her to get his name off of it but i
cant believe it until i see it. an attorney is now out of the question
i was told by several i called this was very expensive for my blood.i
feel like im in a nightmare and need to wake up.my life or death wasnt
never pitcure in my mind like this. sorry so low but i feel hopless
right now. im usuall strong and not a whiner. thanks for your help.

Howdy Brenda,

First thing you want to do is to get a copy of your deed.  You should call the
Butler County Recorder at 513-887-3188 for that.  You need to verify that
indeed another person has been added to your deed.

You will also want to review your mortgage paperwork to see if you authorized
any potential changes to the deed.

For whatever it is worth, Ohio is not a community property state, so if you
have a copy of your original purchase contract for the house, then it should
be easy to show that the house is pre-marital property.

That said, if the new loan is in both of your names, then that might muddy the
waters when it comes to ownership of the house.

The harsh reality is that at a certain point you are going to have to place
your faith in your husband's hands, and trust that his care for you and your
children will have him do the right thing.

You describe yourself as not being in your "right mind," so perhaps your
perceptions of all of this might be a bit skewed.

If you feel that is not to be the case, there might be free or affordable legal
aid for you as well.

thanks for the help,i understood some of what is said but then i
realized how stupid i am too all this.  this house was bought for me
in 1990.was kept in my parents name on a 15 year loan unti i pif which
i did in 2005.then it was turned over in my name.i made all
payments,repairs ect. but now i see ive lost my sons share due to this
marriage. i was married in 1998 which now i guess this mean it is half
his no matter what i do.  the only chance i see me having is after my
father passed my mom had a land contract,not professional wrote out
for me and was notorized. i have to check but i believe we were
married at the time of this also. i cant think good right now. do u
know if i go to an attorney now if it would be legal if my spouse
agrees to everything like a prenup but not will work,he says he would
but talk is cheap.any more suggestions is good.i have noone to talk
too and im losing it here.thanks again

I really think that you should talk this through with your husband
because he might be able to help you sort this out in your mind.

You might be worrying unnecessarily, as people often do when they are upset.

We need to take this one step at a time, carefully and calmly.

First, Bryan's advice is very good.  Communicate with your husband and try to
make sense of all of this together.

Your children's welfare is of huge consideration this matter, and your husband
no doubt feels this.  He is your partner in all of these things.

I realize all of this is very hard on you, but approaching it with as clear of
mind as possible is going to be the best way.

Please call the Butler County Recorder at 513-887-3188 and explain that you
are unable to visit them in person, and see if they can tell you the name(s)
on the deed for your property.

They should be able to provide that information for you.  Alternatively, you
can go to the following website and attempt a lookup of this information.
