Hi, I am writing about amicus curiae briefs independently submitted to international jurisdictions such as the ICJ; ICTY; ICTR; WTO; ICC; etc. It is very difficult to get a hold of such documents, but I found a list for the ICTY and the ICTR. I would be prepared to spend USD 5 for every amicus brief or order pertaining to such a brief that you can send me in pdf or a word file. The link list seems to be old somewhat, that is why I can't get access through the links mentioned to the briefs or the request for leave, or the decisions of the tribunal pertaining to such briefs. At the ICTY the list is available at: http://www.law.mcgill.ca/justice/amicus-en.html How can I get to the briefs and orders mentioned? can you send them to me? At the ICTR the list is available at: http://www.law.mcgill.ca/justice/ac-tpir-en.html The only one I have are the Petition and Appeal Brief of the ICDAA in the Akayesu case Case. no ICTR-96-4-A and for the WTO there has just been a request for leave by Canadian Indians. cf.: http://story.news.yahoo.com/news?tmpl=story&u=/ap/20020430/ap_wo_en_bu/wto_canada_indians_1 can you find that request? |

Dear Mistral: Thanks for your question! All of the documents linked at the law.mcgill.ca website are broken because of a problem with McGill server. I have provided correct links to most of the documents below: Here are all the corrected links from the page http://www.law.mcgill.ca/justice/amicus-en.html: Amicus Curiae Brief Applications from the Baskic Case: http://www.un.org/icty/BL/17docs.htm Order granting leave to appear as Amicus Curiae and to file a brief to Max Planck Institute for Comparative Public Law and International Law, April 11, 1997, http://www.un.org/icty/blaskic/trialc1/order-f/70411SP22.htm Order granting leave to appear as Amicus Curiae and to file a brief to M.A. Pellet on behalf of Juristes sans Frontières, April 11, 1997, http://www.un.org/icty/blaskic/trialc1/order-f/70411SP21.htm Order granting leave to appear as Amicus Curiae in the case of Colonel Aleksa Krsmanovic March 20, 1996) http://www.un.org/icty/BLS/05docs.htm Response to the Order Challenging the Leave requested by Croatia to be Amicus Curiae, May 15, 1996 and Order on Croatia's Request to Appear as Amicus Curiae (the request is dismissed), May 24, 1996) http://www.un.org/icty/BLS/07docs.htm Order Denying Leave to Appear as Amicus Curiae, May 3, 1996 ). http://www.un.org/icty/BLS/07docs.htm Government of USA / Juristes sans frontières http://www.un.org/icty/BLS/01docs.htm These are all the amicus curiae brief links on the McGill server. In addition, I have also found additional links with full text amicus curiae briefs in international jurisdictions: Georgetown University has documents from "Amici Curiae in a Recent NAFTA Case" http://www.law.georgetown.edu/iiel/amicuscuriae4.html Field.org.uk has a PDF file of a asbestos-related amicus cariae filing to the WTO: http://www.field.org.uk/papers/pdf/asbestosamicus.pdf The World Wildlife Federation has full text of a amicus curiae brief on the Shrimp-Turtle Dispute, submitted to the WTO: http://www.panda.org/resources/publications/sustainability/wto-acb/ I hope this information helps! If you need any clarifications, I would be more than happy to assist you further! Please don't hesitate to ask. =) Best Regards, blader-ga | |

This is a great answer! Of course I need the briefs themselves and not a page of the tribunal where it only refers to them. Therefore I gave only 4 stars, but perhaps that is unfair, because it might be impossible to find more - that is exactly why I asked... The answer came very timely and it is of help to me to know that even a "google expert" doesn't find more. It is particularly funny to see the reference to http://www.law.georgetown.edu/iiel/amicuscuriae4.html because I am the author of that web page and I will update it shortly. This additional NAFTA and WTO links to amicus material were especially nice of this expert. Thank you! |
