According to freeadvice.com: "Extortion in most states is defined as blackmail; that is, obtaining property through the use of either oral or written threats. The threats can be of physical harm, or harm to one's reputation, livelihood, marriage etc. In some states extortion has only occurred when money or property has actually changed hands as a result of the threat. In other states, just the threat is enough to constitute extortion." http://criminal-law.freeadvice.com/violent_crimes/extortion.htm The Federal Code covering extortion can be read at: http://resource.lawlinks.com/Content/Legal_Research/US_code/Title_18/title_18_41.htm I hope this answers your question. If you need a specific state law, please submit a question clarification request. search strategy: extortion law Nellie Bly |
