Hi Rich11 -- Yes there is probate court in Delaware. http://www.efmoody.com/estate/probate.html Court supervised probate usually takes about 12 months. Attorney's fees are on a percentage basis. A lot will depend on the value of the estate? How much is the estate worth? Usually if it is less than $5,000 then there may be simplified procedures that speed up the process. You can get your question answered by contacting the county courthouse in your area, if you live in Delaware, as that is a simple question that the probate court clerk can answer easily.
