Amendment A is on the South Dakota ballot to be voted on Nov.5. The
amendmant changes the wording of the South Dakota constitution in
regards to the rights of the accused in a criminal prosecution.
According to the information phamplet
(http://www.commonsensejustice.us/pamphlet.htm) distributed by
Amendment A proponents, who I am one, there supposedly was a couple in
Pierre, SD who were convicted of child pornograpy for trying to have
pictures developed of their own toddlers in a bathtub. The opponents
of Amendment A claim this case never occured.  If this case did in
fact happen what are the details of this case?

  My searches have turned up nothing involving child pornography
convictions in South Dakota involving family photos of toddlers in the
bathtub. I have searched using several different terms and parameters
and nothing remotely close pops up. I did, however, find several cases
in other states involving similar circumstances which resulted in
convictions. Would you be interested in re-formulating your question
for references on these cases, so you would have some ammunition for
Amendment A, even though the particular cases were not in your home
state?

Dear Umia-ga:

Thank you for your prompt response to my question.

I don't think convictions from other states would be of help to us as
our opponents have come out and accused us of fabricating our Pierre,
SD story.  We believe the story is true but have no hard evidence.
We were told this story by someone while gathering signatures in order
to place the amendment on the ballot.  And since publishing the
information phamplet many people from that part of the state have told
us they remembered when the case was in court.  We think it may have
been so long ago that it's off the record now.  rollermillbill-ga

I did quite a bit of searching also. The only references I find to
this case are where it is mentioned as being part of the Amendment A
argument itself. On the plus side, I also did some checking on the
urban legend sites and your story does not appear as a known myth.
