Is this for use in a home warranty for a heating system or as an
outside supplier of a heating source?  If it is the former, one

"HEATING SYSTEM (if Main Source of Heat to Home): 

"Standard Plan Covered Items: All parts and components that affect the
operation of the heating unit. FNHW/CHW will not pay in excess of
$1,500.00 aggregate per contract term for access, diagnosis and repair
or replacement of hot water, radiant heat, steam circulating, air
transfer, lithium/glycol, diesel or hydraulic heating system(s),.
FNHW/CHW will not pay in excess of $500.00 aggregate per contract for
access, diagnosis and repair or replacement of concrete-encased in
inaccessible ductwork.  Openings made for access to concrete - encased
or inaccessible ductwork will be closed to a rough finish only and
subject to the $500.00 limit indicated.

"Not Covered: Solar heating systems - Geo-thermal systems – Phoenix,
Glycol or Polaris systems and water source heat pumps – well pump and
well pump components for Geo-thermal and/or water source heat pumps -
portable and free standing units - humidifiers and electronic air
cleaners - dampers - fuel storage tanks - registers and grills -
filters - heat lamps - fireplace inserts and key valves - flues and
vents - ductwork where asbestos is present - improperly sized heating
systems.

"Additional Comprehensive Option & Comprehensive Plus Plan Covered
Items: Registers and grills - filters - heat lamps. FNHW/CHW will pay
up to $250.00 aggregate (combined limit for the term of the contract)
to correct a code violation and/or code upgrades in relation to a
covered heating, electrical, plumbing or water heater trade service
call if necessary to effect repair or replacement."

I'm looking for an industry standard form CEM contract based broadly
on the following formulae with final prices/values to be slotted in.
Monthly charge = variable charge + Standing charge
Variable charge = EC + HC
EC= MWhe x $/MWhe
HC= MWht x $/MWht
Standing Charge = OET + FET
OET = monthly fixed operating costs
FET = Base line capital or finance cost (related to capital employed)
x N/100
N = percentage of maximum consumption in the month.
It may end up as a take or pay contract, so provision for OET charges
to be adjusted to reflect the fact that energy might not be consumed.
Alternatively we need to make provision for a minimum FET and our
customer will get a guaranteed supply of heat
In either case, I'm interested in clauses covering warranties,
liabilities and un-planned outages
