I live in RI.  I was rear ended and suffered property damage and a
whiplash in an auto accident.  The other guy's insurance company has
accepted full liability
for medical payments, repair of my car, and for "pain and suffering" 
So far they have been very cooperative.  However, when the time comes
to negotiate a settlement for pain and suffering, I do not have a clue
as to how much to ask.  Do they have a table they consult?  a formula
they use?  Where can I get a copy?  The insurance company is
Progressive.  I am not using an attorney because I do not think they
can earn their 1/3 as long as I do a little homework.

Hi phil43,

I was not able to find the guidelines you're seeking and don't think
they're going to be available on the Internet. I did find this site
which has some good negotiating advice:

You might want to contact a good personal injury attorney before
deciding how to proceed, keeping in mind that you are a rookie
negotiating with seasoned insurance company professionals. The
attorney may just be worth the 1/3 fee.

The approach seems reasonable and objective.

In addition, I suggest that you look at a series of articles that were
written by Dan Baldyga for About.com’s Auto Repair site.  Start with
this one, “The Insurance Corner,” and then read the articles shown in
the box to the right:

His approach is a little more cynical than the first author.  It is
also very detail-oriented and he has a lot of practical tips and
advice.  I see that he has also written a book which "will help you to
calculate the value of your personal injury so as to determine how
much your pain and suffering is worth."  You can read more about that

I have received a settlement for an accident that included pain and
suffering. The standard formula is usually 3 times the dollar amount
(in addition to) of the medical bills. My medical bills were $1,200,
and the pain and suffering portion was $3,600 for a total of $4,800.
My attorney took 30% ($1,440) of the total. So here is the breakdown:

Total $4,800
Attorney $1,440
Medical $1,200

Net to me: $2,160

It may work differently in R.I.
