I ordered cigarettes through CIG Mall which were not received. I submitted a dispute to my credit provider after sending two emails to CIG Mall Customer support but receiving no product or credit. I am now receiving threatening emails from Irene Sullivan, CIG Mall Customer Support. She is threatening to report me to various agencies. Can she do this legally? What are my legal exposures if she does? The email is below Dear Joe, We have received notification from our bank that the transaction below has been back-charged: Order Code: 55286-641511 Items Ordered: Marlboro Lights (brown Filter) (4 cartons) Total: USD 68.00 Please let me know the reasons for disputing this order. Order was shipped on on December 15, 2005 from Saint-Petersburg, Russia and should have arrived already. We can prove the shipping by postal receipts. Haven't you received the order or there is another reason? As we are an European based company we don't provide any information about our clients purchases to the state taxes authorities as requested in the case of cigarettes. We don't want to cause you some kind of inconveniences as you did in fact. That's why we request you to pay us for the merchandise we sent otherwise we'd be forced to take some legal action on our side. At first we will notify your city and state taxes authorities and police about the fact of you buying cigarettes via Internet. To prevent complications, we have temporarily prevented further ordering in our stores until this dispute has been resolved. In order to resolve the charge-back you do not need to contact your credit card company. We will instruct you on how to do that to the best advantage. We look forward to your prompt reply so that we may effectively work together to resolve this issue. If you have some questions or comments please don't hesitate to contact us. If you never received the package or there is NO PROOF AT ALL that it has been successfully shipped to your mailbox then you have the right to dispute it because you never signed for anything or there wasnt a tracking number on it so you can say it probably got lost. Not much else can be done there..It happens all the time, its best to just buy it at the local store. Also maybe forward that email to your credit card company for dispute. |

I have checked their site and they give a ... Guarantee Will I get my money back or have the goods replaced if the parcel is lost, stolen or damaged? CIGmall.Biz offers a 100% money back guarantee covering the price of the cigarettes and shipping costs if, for any reason, the purchase is not deemed satisfactory. This says it ALL and I would send a copy of this so-called Guarantee to CIGmall.biz AND to your Credit Card Company. This was a big try-on and happily you didn't fall for it! All the Best Bryan |

Oh yes ... Better take a copy of their 'Guarantee' real soon because you can bet that it will disappear in the course of time. |

Joe, I can't see that anyone in the US would be interested in a few packets of cigs that never arrived! Here's the email that I would send: Dear Irene Many thanks for your email and for your Valentine Wishes. It now occurs to me that the US Customs Service may well have confiscated the goods as contraband. In any event, you can be assured that the US Customs Service will take a close interest in any further shipments of cigarettes that you make to the US. The risk of ordering cigarettes from overseas is great. You would be better off ordering from one of the USA based Native American Cigarette Shops. Why not try something US based like http://www.BlackHawkTobaccoShop.com ? You might not get to order all those commercial name brand cigarettes from the Russians, but at least you won't get ripped off. |
