I received a traffic ticket for speeding from a NYS Trooper while on I-88. One thing i noticed was the officer did not have his hat on when he came to the car to get my licence, or when he returned with the ticket. Now i'm not sure if this is a myth or not, but I had always heard that a trooper is not in full uniform if they do not have their hat on, and therefore the ticket is not valid. does anyone know if this is fact or fiction? the other part of the situation was that apparently the officer was traveling west, and i was going east on a divided highway. (when he pulled me over he said he had passed me a few min ago) The officer said i was doing 90, which shocked me, and then he said "well 88 or 89mph" when he wrote the ticket it was for 87 in a 65. I've also heard that you can ask to see the radar/laser gun, and that they need to save your speed on the gun. It made me suspicious when he stated 3 different speeds. anyway, is there anything that i could do to possiably have this ticket thrown out? I live about 6 hours from where i received the ticket, so i'm not even sure if i can make the court date in person. thanks for any help. |

Amazing what myths are out there. Let's start with the last comment first; either make court,pay the ticket in advance (unless it is a "must appear" ticket) OR risk having your license suspended and the next time you're stopped for something you run the risk of being arrested for driving while suspended. Let me know if the "he didn't have hat on" defense works in court. |

Total, utter, myth. A ticket is just a "temporary arrest" you are considered "arrested" but you are quickly released. An officer does not need to be in full uniform to arrest anyone. |
