My fiance is a Pakistani national working in the UK with a 60 month
work permit. I am a Pakistani national in Pakistan. We wanted to get
married on the telephone (nikah) so then I may apply for a dependants
visa from Pakistan instead of going to the UK on a marriage visa then
coming back to Pakistan again for my dependants visa. Kindly let me
know if this kind of marriage is acceptable for visa purposes

Dear celestine123-ga ,

If the telephone marriage takes place when one of the parties is in
the UK then it will not be accepted as the UK does not recognise
telephone marriages. However, if both parties were abroad at the time
of the telephone marriage and the countries involved recognise
telephone marriages then that may be accepted. You must contact the
Immigration and Nationality Directorate to check which countries allow
this.

Please note that at the moment their site is suffering from technical
problems and access is very slow. The below text is from Google cache.

?The formal validity of a telephone marriage is to be determined
according to the laws of the countries in which both parties are
physically present when the marriage takes place. Therefore, a
telephone marriage celebrated whilst one of the parties is in the
United Kingdom will not be valid as telephone marriages are not valid
in this country. In cases where the UK based sponsor was overseas when
a telephone marriage took place and the laws of both countries
recognise such marriages, we cannot deny that the marriage is valid.
Enquiries about the marriage laws of other countries may be referred
to Section 1 of INPD?
