I am answering a complaint Pro Se and am answering each numbered
paragraph individually. There are 5 count in this complaint and I was
named in 4 of the counts. Recently, via a motion to dismiss, I was
dismissed on 3 of the remaining 4 counts. My question is do I still
need to answer the paragraphs in the counts that I am no lonager a
party to? If not, what wording should I use in the answer to represent
the fact that I am not a party to these counts and do not have to
answer them. Any advice would be grreatly appreciated.

A reminder of the "Important Disclaimer: Answers and comments provided on

I would suggest the following terse wording.  The less said in legal matters
is often the best said.

You could place [Not applicable] below the paragraph wherein you are not
named.

You could place the following beneath each paragraph outlining the dismissed
charges.

[Not applicable due to dismissal of count (x) on (date, docket number, etc.)]

Alternatively, you could be more wordy and use something such as this.

[As I am not named within the complaint in the preceding paragraph/point,
it is not applicable to myself, hence no response is needed nor provided.]

[The charges within the complaint in the preceding paragraph/point that were
in regards to myself were dismissed via a motion to dismiss on (date of
dismissal, docket number, etc.), so they are not applicable to myself, hence
no response is needed nor provided.]

If you did not want to do the "paragraph by paragraph" response, you could
use wording such as this.

[Please find below my response to Paragraph (x).

As for Paragraph (x), I am not named within that complaint, so it is not
applicable to myself, hence no response is needed nor provided.

As for Paragraphs (x,x,x), the charges within those complaints that might
have been in regards to myself were dismissed via a motion to dismiss on
(date of dismissal, docket number, etc.), so they are not applicable to
myself, hence no response is needed nor provided.]

If the above will do as the answer to your question, please tell me and I
will post it as such.  Thansk!
